What is Probate ?

If there is no Living Trust established and recorded with the County of San Diego, the Heirs will go through the Court Process known as Probate which is costly and takes a Year or more to complete. 

A Probate proceeding serves many purposes such as gathering and safeguarding the decedent’s assets, paying all legitimate creditors of the decedent, and distributing the Estate’s assets to the appropriate heirs. Probate is a court-sanctioned process that allows the transfer of the decedent’s property to the living heirs. To explain it in a real estate fashion, during a sale the homeowner is required to sign a deed in order to transfer property to the buyer. However, if the homeowner is deceased, then the court needs to appoint a Personal Representative (this person will be an executor named in the will or an administrator if there is no will). The Personal Representative will have the legal authority to sign the deed transferring the house to the buyer, all of which is overseen by the court.

Probate is a public process. As the Personal Representative, it will be Public information that you have been appointed by the Court and you will receive many calls from Investors looking to purchase the property and claim they are offering you a great deal.
